In this case the claimants were seeking summary judgment to enforce the decision of an adjudicator in respect of works undertaken by them for the defendant.

One of the arguments raised by the defendants was that the contract contained an arbitration clause and therefore the court proceedings should be stayed to arbitration. The court concluded that on this claim the defendant had no defence and therefore gave summary judgment to the claimants.
